The trial between Microsoft and Surfcast is due on September 3

Back in November, it has emerged that Microsoft had been sued by Surfcast for infringing one of its patents with Windows 8 products, including the operating system, the Surface tablet and Windows Phone 8.

The first trial of the lawsuit will take place on September 3, according to a report by Neowin, so the two companies are probably working on the case as we speak.

In just a few words, Surfcast claims that Windows 8’s live tiles are infringing its patent for “a system and method for simultaneous display of multiple information sources.”

Microsoft, on the other hand, has its own patent filed in 2006 and granted in 2011 that covers a “tile space user interface of mobile devices.”

Surfcast didn’t say if it was seeking financial damages, but the company previously said that it “has been and continues to be injured and damaged by Microsoft’s contribution to the infringement of the 403 patent by users and customers.”
