The new Windows 8 Start Screen, the one released to replace the traditional Start Menu, comes with very appealing live tiles that show information and change their design according to the information they provide.

While they indeed look great, they’re not Microsoft’s. Or that’s what a technology designing company claims.

SurfCast has filed a complaint in the US District Court of Maine, claiming that Microsoft infringes one of its patents with all Windows 8 devices, including the new OS, the Surface tablet and the Windows Phone 8.

As always, SurfCast wants Microsoft to “account for and pay to SurfCast all damages caused to SurfCast by reason of Microsoft's patent infringement.”

It appears that SurfCast filed for the patent in October 2000, while Microsoft learned about it in 2009.

“SurfCast has been and continues to be injured and damaged by Microsoft’s contribution to the infringement of the 403 patent by users and customers,” SurfCast concludes in the complaint.
